Ali J.C loses appeal case against Mela Danzaria in Abuja court
The Court of Appeal (FCT) Abuja Judicial Division, on Tuesday, struck out an appeal instituted by Hon. Isa Ali J.C of the Peoples Democratic Party, and former lawmaker against Incumbent Hon. Victor Mela Danzaria of the All Progressive Congress.
In a suit no: CA/ABJ/PBE/ROA/CR/687/M/2021 between Hon. Isa Ali the appellant and Hon. Victor Mela Danzaria as the respondent.
The presiding judge, Justice Mojeed Awoade JCA issued the order striking out the appeal of Hon Ali Isa J.C against the incumbent Hon. Victor Mela Danzaria for lack of competence, thereby making the case to be struck out.
The legal counsel to Hon. Victor Mela Danzaria led by Barrister Adekunle Taiye Falola Esq. having argued and presented genuine cause for discontinuation of the case by virtue of the provisions of the constitution relied on section 241(1), section 242 was upheld by the presiding judge.
The presiding judge, Justice Awoade subsequently struck out the case on the basis of absence of tripartite prayers and incompetence and as such it will not waste the precious time of the court.After the ruling, Hon. Victor Mela Danzaria dedicated the victory to the constituents “this victory is for the constituency” he said.
He praised the decision of the court as the last hope of the common man, which has seen him win the 8 court cases instituted against him by Hon. Ali Isa J.C of the PDP, since assuming office in 2019 with the mandate of the good people of Balanga/Billiri Federal Constituency.Hon. Victor Mela Danzaria reiterated that he is more determined to ensure that the dividend of democracy gets to the people.
Recall that since the case on June 18, 2021 in Bwari FCT High Court had quashed and voided the alleged conviction to jail by a lower magistrate ruling after Hon. Victor Mela’s appeal was considered and upheld.
