The Gombe state election tribunal has dismissed the application against Usman Kumo of the APC representing Akko federal constituency which was filed by Aishatu Mohammed Bose Ahmed candidate of the PDP With file No EPT/GM/03/HR/2019. In a judgement read by Justice Nurudeen Abdullahi, he noted “that there was no time that the 1st Respondent was disqualified in the eyes of the law. So the application has collapsed like a pack of cards. The issue is therefore resolved in the favour of the respondents this will automatically resolve the issues in their favour. The petitioners petition failed for lack of merit. The petition is dismissed” he stated.
Counsel to the petitioners (Aishatu Mohammed and PDP) Barr. Habu Abdu, said “It is like any other judgement. Once we collect the judgement and order, we will study and know where our options are.
The petitioners prayed the tribunal to disqualify the APC candidate, that “The 1st Respondent was at the time of the election not qualified to contest for the post of member representing Akko Federal Constituency of Gombe state in the election.
“The 1st respondent submitted to the commission (3rd Respondent) affidavit containing false information of a fundamental nature in aid of his qualification for the election held on the 23 February, 2019 for Akko Federal Constituency of Gombe state.
Meanwhile, Barr. H.N Nwoye, counsel to (1st Respondent Usman Kumo) said “That the petition, we filed preliminary objection, it succeeded. The petition has been stroke out for lack of jurisdiction by the tribunal and it was dismissed for lack of evidence, that it lacked merit. It is victory for democracy, Akko People for having confidence in my Candidate”.
Counsel to the All Progressives Congress Ibrahim Aliyu, said “the judgement is well written and it is scholarly. It has resolved all the issues and we are very satisfied”.
It is worthy of note that candidate of (PDP) polled 28,631 and Usman Bello Kumo (APC) 57,490 in the last general elections.
