False Evidence: Court acquits Gombe Lawmaker, VMD

The FCT High Court sitting on appeal in Bwari, Abuja, on Friday, discharged and acquitted Hon. Victor Mela Danzaria, the member, House of Representatives, representing Balanga/Billiri Federal Constituency, Gombe State, following his earlier conviction by a Chief Magistrates’ Court, Abuja on the offence of False Evidence.
According to a press statement which was made available to our correspondent by the media aide, to the Lawmaker, Ibrahim Tal, court presided over by Hon Justice O. A. Musa alongside Justice A. O. Ebong, after considering his appeal, upheld same and declared the entire proceedings of the Magistrate Court, his conviction and sentencing as a nullity, baseless and void in it’s entirety.
The Appellate Court held that by virtue of the provisions of Section 31 of the Electoral Act, 2010 (as amended), only the High Court of a State or the FCT can determine the nature of the complaint against him.
The statement added that, the court further held that since provisions of the Electoral Act has specified the court that can try the allegations against Hon. Danzaria, no other court, including the FCT Magistrate Court can try him.
According to the statement Danzaria thanked God almighty and his teeming supporters especially his constituents for their unprecedented support and solidarity.
While hailing the judgement, the Lawmaker also called on the appellant Ali Isa, to team up with him in moving the constituency forward.
The statement partly said, “I have been vindicated from the politically induced and perverse conviction.
“I wish to call on our supporters and sympathizers alike to be magnanimous in victory and further, they must desist from insulting, abusing and dragging anyone in the name of this celebration.
“I want to call on him (Ali Isa) to join me in advancing the cause of the constituency, let’s close our ranks and work to heal our constituency and better the lives of our people.”
