TCDA General Assembly commits to appealing judgement

The General Assembly of Tangale Community Development Association has debunked insinuations that the Executive body was dysfunctional to warrant a parallel caretaker committee, while urging followers to remain resolute.

Periscope Nigeria reports that the Assembly is adjudged the highest decision-making body in the Association.

According to a press statement made available to our correspondent on Friday, the Assembly refuted some claims that the late Mai Tangle Abdu Buba
Maisheru, had dissolved and constituted a caretaker committee in 2020.

Recall that the current Mai Tangle Danladi Maishanu Sanusi Maiyamba, who had constituted a parallel executive, recently got favourable judgement in favour of a TCDA group alleged to be loyal to him.

The Assembly in its update revealed that there was no vacuum, as the body extended the actual cabinet’s tenure by additional six months, following its expiration.

 

The statement partly read, “You may recall that Malam Danladi Maishanu Sanusi Maiyamba, whose
position as the Mai Tangle is currently being contested in two suits at the Gombe State High Court, constituted a parallel TCDA Caretaker Committee.
Consequently, in response to the said action, TCDA Board of Trustees (BOT) filed a suit in a Gombe State High Court No.3. Malam Danladi Maishanu Sanusi Maiyamba and his cohort’s claim was
based on Article X of TCDA Constitution, sections (a) as (b) refers. Furthermore,
other reasons surrounding their action are; that the late Mai Tangle Abdu Buba
Maisheru 11 JP OON had dissolved and reconstituted a Caretaker Committee in
2020. Thirdly, that the General Assembly had failed to conduct a fresh election
into the Executive Council of the Association despite that their tenure had expired.

“Whereas above assertion was made, the General Assembly wish to clarify
these issues and update the general public appropriately as follows: That the Agur Sankace TCDA Caretaker Committee that came into being on
20/10/2020 was constituted by the out gone Executive Council led by Mr. K.E
Teleh according to the extant regulations which empowers it, Article xii S 13 & 16.

“The General Assembly extended the tenure of the Caretaker Committee by
another six months to 20/10/2021 which means the Executive are alive and
functional. That as the highest decision-making body, the General Assembly reconstituted another Caretaker Committee at the expiration of tenure of the former. This means that at no point in time was TCDA dysfunctional as to warrant the constitution of a parallel Caretaker Committee claimed by some quarters. Similarly, at no point in time too did the late Mai Tangle of blessed memory constitute a Caretaker Committee for the TCDA as erroneously/mischievously
being peddled.”

While urging interested parties to stay action, the General Assembly revealed that it would commence efforts at appealing the recent judgement.

“That soon after High Court No.3 Gombe State delivered its judgement on the above suit, the General Assembly quickly met and took a decision to appeal against the judgement and paid the enabling fees within five days of delivering judgement.

“As of now, the process of filing the appeal papers is ongoing except is being slowed down due to the annual vacation of judges that commenced on 1st August and will last to early October 2022 when the process will be completed and appeal kicks off.
Based on the High Court N.3 judgment, only the General Assembly can
constitute the Caretaker Committee, order an election into the Executive
Committee/ Council and replace or fill the vacancy of Board of Trustees (BOT) of the Association hence no one can contemplate any action now.
Lastly, every person/body/group should AWAIT the GENERAL ASSEMBLY for further decision/action on the matter/suit under reference, please,” Assembly added.
