Kano State Governor, Engineer Abba Kabir Yusuf, on Wednesday filed an appeal at the Supreme Court, challenging his removal as the Kano State governor by the Appeal Court last week.
In the notice of appeal filed by the New Nigeria Peoples Party it joined the Independent National Electoral Commission as well as the All Progressives Congress as respondents.
The document, which lists 10 grounds of appeal against the judgement of the appellate court, sought three reliefs from the Supreme court, as follows:
An order allowing the appeal and setting aside the judgement of the Court of Appeal delivered on 17th November, 2023.
An order upholding the portion of the judgement of the court of appeal setting aside the judgement of the trial Tribunal in petition No: EPT/RV/GOV/11/2023 and making an order as costs in favour of the appellant.
Such further orders as this honourable court may deem appropriate in the circumstances of the appeal.
It should be recalled that last week, the Court of Appeal nullified the election of governor Yusuf by declaring that the non-inclusion of his name in the register of his party held by INEC violated section 177 (c) of the 1999 Constitution, which required a candidate vying for a governorship position to be a member of a political party.
The ruling was contrary to the opinion of the lower Election Petition Tribunal, which ruled that the court lacked the jurisdiction to determine the membership of a party.
The Appeal Cour sacked the governor and declared his opponent, Nasiru Gawuna as the duly elected governor.
To march his words, with action, he headed to the Supreme Court to upturn the judgement.
In a similar development, Yusuf’s supporters in their hundreds staged a protest in some streets within the metropolis condemning the judgement of the Appeal court.
Kano State law enforcement agents had a Herculen task to control the maddening protesters, comprising the young and old, particularly die hard NNPP supporters.
