An Upper Area Court No. 7 sitting in Jalingo, Taraba State, on Wednesday struck out a criminal case instituted against a Taraba-based businessman, Gabriel Olayinka, for lack of jurisdiction.
Nigerian Tribune reports that Danladi Jubrin had instituted a case of alleged criminal breach of trust against Olayinka, claiming over N300 million before the Upper Area Court.
However, counsel for the defendant, LL Tadok, of P.D. Pius and Associates, had filed a preliminary objection challenging the jurisdiction of the court to entertain the case.
Tadok argued that the matter was civil in nature and urged the court to strike it out for lack of jurisdiction.
In his submission, counsel for the plaintiff, D.G. Tukura, agreed with the position of the defence counsel.
Meanwhile, the presiding judge, Hon. Lawan Jika, struck out the matter and discharged Olayinka.
