Gombe govt contractor flouts High Court restraining order on mechanic village
The lawyer of Emir Integrated Services Nigeria Limited, Barrister Sulaiman Abdulrahim, on Monday alleged that Granscope Construction Limited flouted High Court’s restraining order on mechanic village.
Addressing journalists shortly after Justice Fatima Musa, had slated March 20 for ruling following the decision of the state government to be joined in the suit, Abdulrahim flayed the violators for failing to respect rule of law.
Emir General Integrated Limited is seeking legal redress against Grandscope Construction Limited contractors to the state government for allegedly trespassing on its property without authorisation.
The court had previously restrained the construction firm from entering or commencing construction on the disputed property, pending the hearing and determination of the motion on notice.
He said, “The court sat today, there was this application from the state government to be joined as parties as defendants that was the application that was heard. The court adjourned that it will be giving it ruling on the application and adjourned the matter till March 20 for ruling on the application for joinder to include ministries of works, justice.”
Abdulrahim continued decrying the violation by the contractors saying, “We sat and the court heard us on our motion, on our part we said we don’t have any problem with the government joining as defendants. The only issue was the application to set aside the order we got before, order for interim injunction which was our only objection ordinarily we are not opposing the application to join us. We are opposing their application to set aside the earlier order we got interim injunction to restrain them from continuing development there.”
“Ordinarily, in civilised clime when a matter is filed all parties has to stay action that is what is called rule of law but they refused to comply with even the interim order restraining them we got an application for comital to commit their directors to prison (custodial centre) for failure to comply with order of court. The application is pending,” he added.
Meanwhile, the defendant lawyer Barrister Garba Subi, was unavailable to grant interviews as at the time of filing this report.
