Gombe End SARS panel disposes murder case against Nigeria Army

Following cited lack of jurisdiction Gombe state commission of inquiry into human rights violation by the disbanded Special Anti Robbery Squad SARS and any other Nigerian Police Unit or security agencies in the State on Monday, disposed a murder case involving deceased Usman Adamu, and Sgt. Friday Amiche of the 301 regiment Gombe, petitioned by Samaila Adamu .
Announcing the resolution of the committee, Chairman, Justice Sa’ad Mohammed (retd.) stated that the timeframe of the case is outside the May 29 2019 date as indicated by the governor.
He said, “The petitioner tried to argue along the line of claiming damages on brutality by Nigeria Army leading to the death of the Victim.
“However, having conferred with the learned counsel the event occurred on 1st July 2010, still outside the period of the terms of reference.
“On the address delivered by the governor, Inuwa Yahaya upon inaugurating the commission he did not mention the specific dates, it is neither here nor there but the terms are clear as to the period failure to address the date does not change the reference.
“The question on the panel of inquiry is jurisdictional, the petition is therefore struck out following jurisdiction.

Lawyer to deceased Samaila Adamu, Barr. Usamatu Abubakar prayed the commission not to jettison the prosecution of the case because it is outside the time recommended.
He said the deceased died at the regiment cell located at quarter guard, after spending three days without trial.
According to him, the victim was arrested by Special Anti Kalari Squad led by the Army.
“it is undeniable that the governor asked the commission to address issues of violations from may 29, 2019. Justice demands that justice should be given to victims outside the the timeframe,” Abubakar said.
However, investigation by our correspondent revealed that out of 15 cases so far filed by complainants only about 3 will not be faced with jurisdiction as most of them happened outside the recommended date.
So far 8 have been heard and disposed with 7 others left for hearing.

With respect Sir, I equally Support your View With regards to time frame of filing a complaint before your Panel though not Stated Vividly by the Executive Governor of Gombe State.
